Jamie Hines appeared in a bail application in Shepparton Magistrates’ Court where it was heard he entered the changerooms of the Wyndham St store and put Adidas tracksuit pants on under his own pants.
He also allegedly placed a basketball jersey down his pants.
After waiting for the accused to exit the changerooms, police noticed him attempting to conceal the jersey, while a full search once back at the Shepparton Police Station revealed the tracksuit pants he was wearing.
The items had a combined value of $194.98.
The court heard of an outstanding matter from June 30, where Hines took a $270 pair of shoes from the same store.
Hines was bailed to residential rehabilitation facility The Cottage, but was discharged one month into a three-month program.
Hines said he had "just been running really low on clothes".
“I stole a t-shirt and a pair of pants and I'm looking at more jail time,” he said.
“Last time it was sneakers and I did four months jail for that.”
Needing to show exceptional circumstances to be granted bail, Hines said he was "really close" to being able to reconnect with his three children, that he had only "jumped the fence" at The Cottage to help a friend who was in trouble, and that his current drug use was "nothing compared to what it was".
But Magistrate Peter Mithen denied bail, with Hines remanded to appear in court on February 10.
“Nothing there is exceptional circumstances, the brutal fact is you were on bail,” he said.
