Mark Barlow, 51, and Brian Barlow, 56, both of Wanalta, appeared in Shepparton Magistrates’ Court on Monday facing several charges under the Wildlife Act and the Firearms Act.
On March 16, 2019, the pair took part in the opening weekend of the duck season on their family's Wanalta property.
The court heard the accused were caught by authorities about 11 am with a shotgun, ammunition and ducks in the tray of their ute.
Department of Jobs, Precincts and Regions senior lawyer Megan Hood told the court the firearms found were not registered and the men did not have game licences or firearms licences. Ms Hood also said lead ammunition was used on the day, which is illegal for hunting purposes due to its toxic impact on the environment.
Defence lawyer Elricia Schoeman said her clients were highly regarded members of their community, with no prior convictions.
Ms Schoeman said the men had been co-operative and confirmed the firearms were safely secured year-round.
Magistrate Peter Dunn said he was confused as to why the men were using such safety measures but had not taken the necessary licensing precautions.
“Times have changed, the world has moved along,” Mr Dunn said.
“Your clients need to be innovators in current farming practices.”
Mr Dunn ordered all property to be destroyed and fined each man $5000 without conviction.
