The committee was established as a special committee under section 86 of the Local Government Act 1989 to oversee the strategic operation of the Benalla Art Gallery.
However, the recently enacted Local Government Act 2020 does not provide for special committees to continue operating.

The new act allows three types of committees; a delegated committee, a community asset committee appointed to manage a council asset or an audit and risk committee.
Councillor Barb Alexander said it was a "no-brainer" to shift the Benalla Art Gallery Committee under the Community Asset umbrella.
“Our council is one that follows good governance and follows the right protocols,” Cr Alexander said.

The biggest change to the committee's make-up would be the exclusion of Benalla Rural City chief executive officer Dom Testoni, with the committee instead reporting to Mr Testoni.
The council report also proposed all current members of the committee be re-appointed to this new committee.
The committee is comprised of two Benalla Rural City councillors, the chief executive officer of Tourism North East, up to six general members, and the president or delegate of the Friends of the Benalla Art Gallery Inc.

All non-councillor appointments expire on May 31, 2023, while council members are appointed annually by the council.
The job of the committee is to develop and monitor the strategic plan for the gallery alongside relevant council officers. They meet at least four times a year.
