Broadcaster Derryn Hinch has won the right to argue before a full bench of the High Court that suppression orders he allegedly breached are constitutionally invalid.
Mr Hinch is charged with breaching court suppression orders by naming two sex offenders at a victims of crime rally in 2008 and on his website.
He appeared in the High Court in Melbourne yesterday when his lawyers asked to move his case from the Magistrates Court to the High Court so he could challenge the orders.
